ြပည်ေထာင်စုလွှတ်ေတာ်သည် ဤဥပေဒကို ြပဋ္ဌာန်းလိုက်သည်။
၁။ ဤဥပေဒကို တရားမကျင့်ထံုးဥပေဒကို ြပင်ဆင်သည့်ဥပေဒဟုေခါ်တွင်ေစရမည်။
၂။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၂ ပုဒ်မခွဲ (၄)တွင်ပါရှိေသာ ''district'' means the local limits of the jurisdiction of a principal civil Court of original jurisdiction (hereinafter called a ''District Court''),and includes the local limits of the ordinary original civil jurisdiction of the High Court;'' ဆိုသည့်စကားရပ်အစား ''district'' means the local limits of the jurisdiction of a principal Court of original civil jurisdiction (hereinafter called a ''District Court''),and includes the local limits of ordinary original civil jurisdiction of the Court of the Self-Administered Division or the Court of the Self-Administered Zone;'' ဆိုသည့်စကားရပ်ြဖင့် အစားထိုးရမည်။
၃။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၂ ပုဒ်မခွဲ (၄)ေနာက်တွင် ပုဒ်မ ၂ ပုဒ်မခွဲ (၄ က) အြဖစ် ေအာက်ပါစကားရပ်ကို ြဖည့်စွက်ရမည်-
Section 2 (4 A) ''civil Court ''means''Court of civil jurisdiction;''
၄။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၂ ပုဒ်ခွဲ (၁၅)၊ ပုဒ်မ ၁၀၃၊ ပုဒ်မ ၁၀၉ ပုဒ်မ ခွဲ (က) (ခ)၊ ပုဒ်မ ၁၁၁ ပုဒ်မခွဲ (က)၊ နဝမပိုင်းေခါင်းစဉ်၊ ပုဒ်မ ၁၁၇၊ပုဒ်မ ၁၁၈ နှင့် ပုဒ်မ ၁၂၀ တို့တွင်ပါရှိေသာ Section 2 (4 A) ''civil Court ''means''Court of civil jurisdiction;'' ဆိုသည့်စကားရပ်အစား ''the High Court of the Region or the High Court of the State'' ဆိုသည့်စကားရပ်ြဖင့် အစားထိုးရမည်။
၅။ တရားမကျင့်ထံုးဥပေဒပုဒ်မ ၂ ပုဒ်မခွဲ (၁၇)ပုဒ်ခွဲငယ်(ခ)တွင်ပါရှိေသာ ''every member of the India Civil Service or of the Myanmar Civil Service (Class I);" ဆိုသည့်စကားရပ်ကို ''every gazetted officer and the superior officer of Civil Services;" ဆိုသည့် စကားရပ်ြဖင့်လည်းေကာင်း၊ ပုဒ်မခွဲငယ် (ဂ)တွင်ပါရှိေသာ ''every commissioned or gazetted officer in the military, naval or air forces of the Government;" စကားရပ်အစား ''every commissioned or gazetted officer of Defence Services;" ဆိုသည့်
စကားရပ်ြဖင့်လည်းေကာင်း အစားထိုးရမည်။
၆။ တရားမကျင့်ထံုးဥပေဒပုဒ်မ ၃ တွင် ပါရှိေသာ-
( က ) ''the High Court" ဆိုသည့်စကားရပ်အစား ''the High Court of the Region or the High Court of the State'' ဆိုသည့် စကားရပ်ြဖင့် အစားထိုးရမည်။
( ခ ) "and every Court of Small causes'' ဆိုသည့်စကားရပ်ကို ပယ်ဖျက်ရမည်။
၇။ တရားမကျင့်ထံုးဥပေဒပုဒ်မ ၂၃ တွင်-
( က) ပုဒ်မခွဲ(၂)တွင်ပါရှိေသာ ''the High Court" ဆိုသည့်စကားရပ်အစား ''the High Court of the Region or the High Court of the State'' ဆိုသည့်စကားရပ်ြဖင့် အစားထိုးရမည်။
( ခ ) ပုဒ်မခွဲ (၂)၏ ေနာက်တွင် ပုဒ်မခွဲ(၃)အြဖစ် ေအာက်ပါစကားရပ်ကိုြဖည့်စွက်ရမည်-
"Where such Courts are different High Courts of the Region or the High Court of the State, the application
shall be made to the Supreme Court of the Union."
၈။ တရားမကျင့်ထံုးဥပေဒပုဒ်မ ၂၄ ပုဒ်မခွဲ(၁)တွင် ပါရှိေသာ ''the High Court" ဆိုသည့် စကားရပ်အစား ''the Supreme Court of the Union'' ဆိုသည့်စကားရပ်ြဖင့်လည်းေကာင်း၊ ''the State or Divisional Court" ဆိုသည့် စကားရပ်အစား ဒ''the High Court of the Region or the High Court of the State" ဆိုသည့်စကားရပ်ြဖင့်လည်းေကာင်း အစားထိုးရမည်။
၉။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၃၅ က၊ ပုဒ်မခွဲ(၂)တွင်ပါရှိေသာ ဒ''100,000 Kyats" ဆိုသည့်စကားရပ်အစား ''1,000,000 Kyats" ဆိုသည့်စကားရပ်ြဖင့် လည်းေကာင်း၊ ပုဒ်မ ၃၅ က၊ ပုဒ်မခွဲ(၂)၏ ွြခင်းချက်တွင်ပါရှိေသာ ''the High Court" ဆိုသည့်စကားရပ်အစား ''the Supreme Court of the Union'' ဆိုသည့် စကားရပ်ြဖင့်လည်းေကာင်း အစားထိုးရမည်။
၁၀။ တရားမကျင့်ထံုးဥပေဒပုဒ်မ ၈၀ ပုဒ်မခွဲ(က)နှင့် ပုဒ်မ ၈၃ ပုဒ်မခွဲ(၂) ရှင်းလင်းချက်တို့တွင်ပါရှိေသာ ''a Secretary to the Government" ဆိုသည့်စကားရပ်နှင့် တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၈၆ ပုဒ်မခွဲ(၁)တွင်ပါရှိေသာ ''a Director General of the Office of the Government" ဆိုသည့်စကားရပ်အစား ''a Secretary to the Union Government" ဆိုသည့်စကားရပ်ြဖင့် အစားထိုးရမည်။
၁၁။ တရားမကျင့်ထံုးဥပေဒပုဒ်မ ၁၀၀ ပုဒ်မခွဲ(၁)တွင်ပါရှိေသာ "the High Court" ဆိုသည့် စကားရပ်အစား "the High Court of the Region or the High Court of the State" ဆိုသည့်စကားရပ်ြဖင့် လည်းေကာင်း၊ "the State or Divisional Court" ဆိုသည့်စကားရပ်အစား "any Court Subordinate to the High Court of the Region or the High Court of the State" ဆိုသည့်စကားရပ်ြဖင့်လည်းေကာင်း၊ ပုဒ်မ ၁၀၀ ပုဒ်မခွဲ(၁) ပုဒ်မခွဲငယ် (ဃ) တွင်ပါရှိေသာ ''2,000,000 Kyats" ဆိုသည့် စကားရပ်အစား ''1,000,000 Kyats" ဆိုသည့်စကားရပ်ြဖင့်လည်းေကာင်း အစားထိုးရမည်။
၁၂။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၁၀၂ နှင့် ပုဒ်မ ၁၁၄ ပုဒ်မခွဲ (ဂ) တို့ကိုပယ်ဖျက်ရမည်။
၁၃။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၁၀၆ တွင်ပါရှိေသာ ''the State or Divisional Court" ဆိုသည့် စကားရပ်အစား ''the High Court of the Region or the High Court of the State" ဆိုသည့်စကားရပ်ြဖင့် အစားထိုးရမည်။
၁၄။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၁၁၀ တွင်ပါရှိေသာ "ten thousand Kyats" ဆိုသည့်စကားရပ်အစား ''10,000,000 Kyats" ဆိုသည့်စကားရပ်ြဖင့် အစားထိုးရမည်။
၁၅။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၁၁၃၊ ပုဒ်မ၁၁၉၊ ပုဒ်မ ၁၂၂၊ ပုဒ်မ၁၂၄၊ ပုဒ်မ ၁၂၉ နှင့် ပုဒ်မ ၁၃၃ ပုဒ်မခွဲ (၂)တို့တွင်ပါရှိေသာ ''the High Court" ဆိုသည့်စကားရပ်အစား ''the Supreme Court of the Union" ဆိုသည့် စကားရပ်ြဖင့်အစားထိုးရမည်။
၁၆။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၁၁၅တွင်-
(က) ''The High Court" ဆိုသည့်စကားရပ်အစား ''The Supreme Court of the Union" ဆိုသည့်စကားရပ်ြဖင့် လည်းေကာင်း၊ ''the State or Divisional Court'' ဆိုသည့်စကားရပ်အစား ''the High Court of the Region or the High Court of the State'' ဆိုသည့် စကားရပ်ြဖင့်လည်းေကာင်း အစားထိုးရမည်။
( ခ ) ပုဒ်မ ၁၁၅ ၏ ပထြမွခင်းချက်တွင်ပါရှိေသာစကားရပ်ကို ေအာက်ပါအတိုင်း အစားထိုးရမည်-
'' Provided that no application to the Supreme Court of the Union shall be made to revise the order of the High Court of the Region or the High Court of the State in the exercise of its revisional jurisdiction passed against the order of any subordinate Court to the High Court of the Region or the High Court of the State in revision."
( ဂ ) ပုဒ်မ ၁၁၅ ၏ ဒုတိြယွခင်းချက်ကို ပယ်ဖျက်ရမည်။
၁၇။ တရားမကျင့်ထံုးဥပေဒပုဒ်မ ၁၂၃ တွင်-
(က) ပုဒ်မခွဲ(၁)တွင် ပါရှိေသာ ''at Yangon" ဆိုသည့်စကားရပ်အစား ''at Nay Pyi Taw" ဆိုသည့် စကားရပ်ြဖင့် အစားထိုးရမည်။
( ခ ) ပုဒ်မခွဲ(၁) ပုဒ်မခွဲငယ် (က)တွင် ပါရှိေသာစကားရပ်ကို ေအာက်ပါအတိုင်းအစားထိုးရမည်-
''three Judges of the Supreme Court of the Union,''
( ဂ ) ပုဒ်မခွဲ(၁) ပုဒ်မခွဲငယ် (ခ)တွင် ပါရှိေသာစကားရပ်ကို ေအာက်ပါအတိုင်း အစားထိုးရမည်-
''two Judges of the High Court of the Region or the High Court of the State, and''
(ဃ) ပုဒ်မခွဲ(၁) ပုဒ်မခွဲငယ် (ဂ)တွင် ပါရှိေသာစကားရပ်ကို ေအာက်ပါအတိုင်း အစားထိုးရမည်-
''two advocates who have practised as advocates for at least 10 years."
( င ) ပုဒ်မခွဲ(၁) ပုဒ်မခွဲငယ်(ဃ)ကို ပယ်ဖျက်ရမည်။
( စ ) ပုဒ်မခွဲ(၃)၊ ပုဒ်မခွဲ(၃)ြခွင်းချက်၊ ပုဒ်မခွဲ(၄)နှင့် ပုဒ်မခွဲ(၅)တို့တွင်ပါရှိေသာ ''the Chief Justice" ဆိုသည့်စကားရပ်၏ ေနာက်တွင် ''of the Union'' ဆိုသည့် စကားရပ်ကို ြဖည့်စွက်ရမည်။
(ဆ) ပုဒ်မခွဲ (၃) ြခွင်းချက်တွင်ပါရှိေသာ ''other Judges' ဆိုသည့်စကားရပ်ေနာက်တွင် ''of the Supreme Court of the Union" ဆိုသည့်စကားရပ်ကို ြဖည့်စွက်ရမည်။
၁၈။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၁၂၆ တွင် ပါရှိေသာစကားရပ်ကို ေအာက်ပါအတိုင်း အစားထိုးရမည်-
''The Supreme Court of the Union shall distribute and submit the rules made under the foregoing provisions to its representative at the nearest regular session of the Pyidaungsu Hluttaw with the permitted arrangement of the Speaker of the Hluttaw.''
၁၉။ တရားမကျင့်ထံုးဥပေဒပုဒ်မ ၁၃၆ ပုဒ်မခွဲ(၄)တွင် ပါရှိေသာ ''the Hight Court'' ဆိုသည့်စကားရပ်အစား ဒ''the Hight Court of the Region or the High Court of the State'' ဆိုသည့် စကားရပ်ြဖင့်လည်းေကာင်း၊ ''Yangon City Civil Court" ဆိုသည့်စကားရပ်အစား ''Court of the Self-Administered Division or the Court of the Self-Administered Zone or the District Court'' ဆိုသည့်စကားရပ်ြဖင့်လည်းေကာင်း၊ ''as if were the District Court'' ဆိုသည့် စကားရပ်အစား ''according to the procedure provided in the foregoing provisions of sub-section (2) and (3)" ဆိုသည့် စကားရပ်ြဖင့် လည်းေကာင်း အစားထိုးရမည်။
၂၀။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၁၃၇ တွင်-
(က) ပုဒ်မခွဲ(၁)တွင် ပါရှိေသာ စကားရပ်ကို ေအာက်ပါအတိုင်း အစားထိုးရမည်-
''The Language of the Supreme Court of the Union and any Court subordinate to the Supreme Court of the Union shall be Myanmar Language.''
( ခ ) ပုဒ်မခွဲ(၂)တငွ် ပါရှိေ သာ စကားရပ်က်ို ေအာက်ပါအတိုင်း အစားထိုးရမည်-
''The application to and proceeding in such Courts shall be written in Myanmar language.''
၂၁။ တရားမကျင့်ထံုးဥပေဒ ပုဒ်မ ၁၃၉(ခ)တွင် ပါရှိေသာ ဒ''the High Court'' ဆိုသည့်စကားရပ်အစား ''the Supreme Court of the Union, the High Court of the Region or the High Court of the State '' ဆိုသည့်စကားရပ်ြဖင့်အစားထိုးရမည်။
